1. Acceptance of Terms
By downloading, installing, or using Dead On ("the App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the App. We may update these terms from time to time, and your continued use of the App after changes are posted constitutes acceptance of those changes.
2. Description of Service
Dead On is a woodworking calculator app for iOS. It provides tools for fraction math, board feet calculation, dovetail spacing, box joint layout, dado and groove sizing, mortise and tenon proportions, and wood movement estimation.
The App is available in two tiers:
- Free — Includes the fraction calculator and basic board feet calculator.
- Dead On Pro — A one-time purchase that unlocks all calculators, project saving, and iCloud sync.
3. In-App Purchase
Dead On Pro is a one-time, non-consumable purchase priced at $4.99 (USD). It is not a subscription and does not recur. Once purchased, you own it permanently and can restore it on any device signed in to the same Apple ID.
All purchases are processed by Apple through the App Store. We do not handle payment information directly. Refund requests must be directed to Apple, as Apple controls all App Store transactions. For refund assistance, visit reportaproblem.apple.com.
4. iCloud Sync
Dead On Pro uses Apple's iCloud (CloudKit) to sync your projects and saved calculations across your devices. This sync is handled entirely by Apple's infrastructure and is subject to Apple's iCloud Terms of Service. You must have an active iCloud account and sufficient iCloud storage for sync to function. We do not operate any servers or store your data outside of your device and Apple's iCloud.
5. Speech Recognition
Dead On supports voice input using Apple's on-device speech recognition framework. All speech processing happens locally on your device. Audio data is not sent to any external server, including ours. We never receive, store, or have access to your voice data.
6. Intellectual Property
The App, including its design, code, icons, graphics, and content, is owned by Chad Berry / Cognfy LLC and is protected by copyright and other intellectual property laws. You may not copy, modify, distribute, reverse engineer, or create derivative works from the App or any of its components. "Dead On" is a trademark of Cognfy LLC.
7. Disclaimer of Warranties
Dead On is provided "as is" and "as available" without warranties of any kind, either express or implied. While we strive for accuracy, all calculations produced by the App are estimates and reference values. Wood is a natural material with inherent variability, and real-world results depend on species, moisture content, grain orientation, tool calibration, and workshop conditions.
Always verify calculations with physical measurements before making cuts. You are solely responsible for confirming accuracy in your workshop. We do not warrant that the App will be error-free, uninterrupted, or that any defects will be corrected.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Chad Berry, Cognfy LLC, and any affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of materials, wasted lumber, project damage, personal injury, or any other damages arising out of or related to your use of the App. Our total liability for any claim arising from your use of the App shall not exceed the amount you paid for the App.
9. Termination
We reserve the right to terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms of Use or is harmful to other users, us, or third parties, or for any other reason at our sole discretion. Upon termination, your right to use the App will cease immediately. Provisions that by their nature should survive termination shall survive, including ownership, warranty disclaimers, indemnification, and limitations of liability.
10. Indemnification
You agree to indemnify, defend, and hold harmless Chad Berry, Cognfy LLC, and their officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the App, your violation of these Terms, or your violation of any rights of any third party.
11. Governing Law
These Terms of Use shall be governed by and construed in accordance with the laws of the State of Ohio, United States, without regard to its conflict of law provisions. Any disputes arising from these terms or your use of the App shall be resolved in the courts of the State of Ohio.
